Welcome to Gina Serfontein Art (“our, us,”). These Terms of Service govern your use of this website, ginaserfontein.art (the “Site”), and the purchase of original and printed artwork available on the Site. By accessing or using the Site, you agree to be bound by these Terms of Service.

If you do not agree to these terms, please refrain from using our Site.

1. Eligibility

You must be at least 18 years old to purchase artwork from this Site. By placing an order, you confirm that you are legally able to enter into a binding contract.

2. Original Artwork

All artwork sold on this Site is original and created by Gina Serfontein. Due to the nature of handmade art, slight variations in texture, color, and detail are inherent and intentional, emphasising the uniqueness of each piece.

3. Payment

Payments are securely processed via Stripe, a third-party payment gateway. By using Stripe, you agree to its Terms of Service.

We accept major credit and debit cards. Payment must be completed at the time of purchase. Your payment information is not stored on our servers and is subject to Stripe’s security and privacy policies.

4. Pricing and Taxes

Prices are listed in Australian Dollars and are subject to change without notice.

Applicable taxes will be calculated at checkout based on your shipping address.

International customers are responsible for any customs duties, import taxes, or other fees imposed by their country.

5. Shipping and Delivery

Artwork will be shipped within 24 hours after payment confirmation.

We offer shipping within Australia only at this time. Shipping costs will be calculated and displayed at checkout.

While we make every effort to ensure timely delivery, we are not responsible for delays caused by shipping carriers or customs.

You will receive a tracking number upon dispatch.

Refund Policy

The return or exchange of artwork is only accepted here at Gina Serfontein Art under certain terms and conditions. We understand that art can look different in person compared to the online representation of the product. We endeavour to represent the artwork to you as best as we can, however, discrepancies in overall colour and texture of the artwork may vary. Returns and exchanges are done on a case-by-case basis. To start a return, you can contact us. If your return is accepted, we’ll send you instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted. You can always contact us for any return questions. The artwork will need to be packaged in the same packaging and in the same way it was sent to you. If the artwork arrives back to us and not packaged correctly and/or any damage has been identified, a refund will be declined and the customer will need to collect the artwork, or arrange payment for the artwork to be re shipped back to them.

Please inspect your order upon receiving and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right. For custom made products such as special orders or personalized items, please get in touch if you have questions or concerns. Unfortunately, we cannot accept returns on sale items.

As per Australia’s consumer protection laws, shipping fees and any and all returned items within good faith are not covered by us. Only faulty merchandise or products not covered under consumer guarantee will return shipment be paid by us.

Liability

We are not liable for goods once they are in the possession of the collector. It is not our duty to refund, exchange, replace, or compensate by any means for the damage of products that have been mishandled by customers. For instance, placing a fingerprint on a white border, ripping the paper, etc.

As guaranteed under consumer protections, compensation for damage is due if/ when damaged products are received when impacted by postal services and/or faulty merchandise had been dispatched. Every print is inspected a minimum of three times before clearing for shipment and only pristine purchased reproductions are packaged for you to enjoy. It is not our duty to compensate customers who do not read the information provided in the product description prior to purchase.

We are confident that you will love your new artwork and are committed to offering the highest quality fine art products for you to enjoy! Below are our policies on returns for each product. We honour a 14 day return policy on eligible products. We do our best to offer colour accurate photography of the artwork, but some calibrations may vary between devices.
To be eligible for a return, your item must be in the same condition that you received it.

All original artwork purchases are final. We do not offer returns, refunds or exchanges for change of mind purchases.

7. Intellectual Property

All content on this Site, including but not limited to artwork, images, text, and logos, is the intellectual property of Gina Serfontein and is protected by copyright laws.

You may not reproduce, distribute, or create derivative works from our content without express written permission.

8. Privacy Policy

Your personal information is collected and used in accordance with our Privacy Policy.

9. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages arising from your use of the Site or purchase of artwork. Our total liability for any claim shall not exceed the amount you paid for the artwork.

10. Governing Law

These Terms of Service are governed by the laws of Australia. Any disputes shall be resolved exclusively in the courts of Queensland.

11. Amendments

We reserve the right to update or modify these Terms of Service at any time without prior notice. Changes will be effective immediately upon posting on the Site. Your continued use of the Site constitutes acceptance of the revised terms.
